AGC MA Opposes Bills Mandating Daily Posting of Names of all Worker on all Private Jobsites

On November 7, an AGC MA delegation met with the House Ways & Means General Counsel to express its strong opposition to Senate Bill 1019 and House Bill 1005 “An Act Relative to Transparency in Employee Benefits Reporting in Private Construction”. Over half of all House members have signed on to the bill.

The legislation attempts to curtail the practice of misclassifying workers as ‘independent contractors’ by requiring that the names of every single worker and independent contractor who is employed at every private construction site over $750,000 be posted on a daily basis, PLUS the posting of unemployment and workers compensation insurance certificates for every firm working on the jobsite.

While it has always been the position of AGC that the intentional misclassification of workers by unscrupulous contractors is harmful to the industry and undermines firms who play by the rules, AGC feels this bill goes too far and will create havoc on the majority of sites.
