On November 16, 2016 Ron Ciotti, Partner, Hinckley Allen and Brian Perlberg, Sr. Counsel for Construction Law, AGC of America presented: Contract Killer Clauses and How to Survive Them.
The program shared in-depth information on what clauses to look for that can put people responsible who can't control the risk.
Some of those clauses to avoid included: “Differing Site Conditions”, be sure to use standardized documents as reference points, “Change Orders”, always get them in writing and “Killer Payment Terms”, be sure to avoid “contingent” and “approval of invoice”-quick payments get better results!
Read your contract thoroughly (optimally with your lawyer) and look for clauses that can be neutralized so that the project can be facilitated in a way that is best for the project.
Bad contracts =bad results. You can pay minimally upfront now with due diligence or potentially face paying the maximum later.
